i know these two married couples. they are 19 and 20. The guy is a u.s. citizen who married his wife who is an international student. because of family circumstances, they cant really live together even tho they have an apartment and bills in their name. WHEN WOULD THE INS DO A CHECK UP?? IS THIS ILLEGAL?How are fake marriages found out? what makes a marriage to be fake?
Alot of different things are checked into when you go for the interview.Living together is one thing they look for when trying to determine if a marriage is a sham or not.But if they have already passed the interview and she has been issued a green card already then there is very little that can be done by you at this point.And I may be wrong on this but from what I heard they werent allowing students to do an adjustment of status with an I-130 petition anymore.How are fake marriages found out? what makes a marriage to be fake?
fake marriages are usually busted when the pigs see a pattern. for example one person arranging multiple marriages. a marriage doesnt necesarily have to be fake for a visa to be refused. all the officials have to do is suspect that it isnt real. on the other hand, if the couple is not able to come up with enough documents ie bank statements, photos, correspondence, proof of accomodation, etc, then the visa will be refused whether the marriage is real or fake. it doesnt matter if it is legal or not. all they have to do is suspect that youre not in a relationship, and you wont be allowed to stay, and will be asked to leave. you are lucky that you even have a visa.
If it is discovered they live in separate apartments, they could be called in for a fraud interview. They could also be called for this when it comes time to change the green card status from conditional to permanent.
They would be interviewed separately and intensively. The questions are probing and very personal. If the marriage is a fraud (i.e. they married to get the green card, not out of love), there is no way to prepare for the questions.
If they are living separately because of circumstances, they should bring copies of documents to prove how often they call or visit each other.

Have they had their interview yet? If not they are not going to pass if they are not living together. A friend and his Colombian wife were recently interviewed in separate rooms and asked personal info you would only know if you lived with someone - what kind of toothpaste is in your bathroom, what brand of shampoo does your spouse use, which side of the bed does your spouse sleep on, what time is your spouse's alarm clock set for in the morning, how does your spouse drink their coffee, what sort of beer is in your refrigerator, what did your spouse watch on TV last night, etc - all questions you could only answer if you were living together
The ICE does conduct investigations when they suspect illegal activity. If a supposed married couple are not sharing living quarters then it is likely the ICE will consider it a sham marriage for immigration purposes and deport the foreign national and charge the other with a crime.
