Is anything regarding gay marriage undertaken by the courts & congress unconstitutional?

That's basically the whole question. All I hear when this subject comes up is references to the bible, which automatically kicks in the separation of church and state clause, doesn't it? So no matter how much you hate it or love it, it can't be considered by any part of the government period. Or am I missing something? Some other argument or anything? Could someone please enlighten me? And couldn't the same be said for abortion?Is anything regarding gay marriage undertaken by the courts %26amp; congress unconstitutional?

The reason you hear about the Bible so much is because that is the obvious source for where and why people decided that homosexual behavior is immoral. No, the government has not created an official religion just because it has enacted a law which reflects a moral value that people learn from their religion. What ever gave you that impression? Legislated morality is not unconstitutional.

Yes, you are missing the historical fact that, as of 50 years ago, every single state in the country had a law which banned ';sodomy.'; Every single state. And most of them had banned ';sodomy'; since the beginning -- as soon as they became states. The federal government still bans ';sodomy'; too. In the military. as far as im considered, neither the government or the people should be able to decide whether homosexuals can get married. in our constitution it says that ';all people are created equal'; and that everyone has rights granted to them that cannot be taken away. if a ';right'; can be taken away, doesn't that make it a privilege? so does that mean that straight people have the ';privilege'; of getting married? due to that, the government shouldnt be able to deny homosexuals the RIGHT to get married, and the people shouldnt be able to vote on it, just like we cant vote on the freedom of speech, free practice of religion, etc.. hope that answered your question.
to me separation of church and state is bogus either way when people vote and are semi-religious they will put religion into their views which if they vote will eventually be counted thus separation of church and state dosen't mean anything
